Ever since the Supreme Court’s decision in Regents of the University of California v. Bakke in 1978, the constitutionality of using race in making admission decisions in higher education has continued to be challenged under the Equal Protection Clause. Join our discussion as we explain the evolution of the Court’s jurisprudence over 45 years from Bakke to Students for Fair Admissions v. Harvard and Students for Fair Admissions v. UNC (both decided in 2023), including how changes in the Court’s composition from 2003 to 2016 to 2023 affected case outcomes.
